Maui Police Arrest MauiTime Publisher Thomas Russo While He Was Filming Their Operation Recon Traffic Stops

Tuesday morning the Maui Police Department arrested Thomas Russo, MauiTime's publisher and owner, after Russo began filming MPD officers on Haleakala Highway during a massive series of traffic stops involving five or six police cars. Maui PD charged Russo with interfering with a government operation, harassment and resisting arrest.

"I stopped to find out why it was so important to back up traffic for miles," Russo said after being released. "Social media was blowing up my phone, asking what was going on there. I wanted a report from the scene. I was arrested for filming and all other charges from the MPD are ridiculous. The police chose to arrest me in a direct attempt to stop the documenting of their activities."

Russo said he walked up to an officer on the side of Haleakala Highway and asked him what was going on. The officer told Russo that they were looking for "traffic violations." Russo then repeatedly asked the officer what gave them the right to back up traffic on a busy morning clear to Hali'imaile.

Russo said a second officer then told him that he was "obstructing" a traffic stop, in contradiction to the first officer who merely told him to "stay on the side." Russo says he repeatedly asked the officers why they're conducting all these traffic stops on such a busy morning.

While swiftly walking backwards but still filming the officers, he said both officers began following him and continuously telling him to "stand back." Still walking back away from the officers, Russo said he identified himself by name and told the officer that he was a member of the media and runs MauiTime. At that point, Russo said Officer Rusty Lawson then told him that he was under arrest. Still walking backwards, away from the officers, Russo said Lawson then arrested him.

Lt. Wayne Ibarra, the Maui Police spokesman, did not provide a statement from the department on the arrest by press time. We will include that statement in a future story on this matter.

    Sounds like outrageous overstepping by MPD. Good on you Tom for stopping by at the scene and expressing your rights as a citizen. I was in that traffic snarl-up.

    So we have:
    1. Police operation oblivious of inconvenience and delay to thousands of commuters in rush hour: Grossly inconsiderate (at the least).
    2. Denying citizens their right to know and ask reasonable questions: Heavy handed/bullying (at the least).
    3. Arresting said inquisitve, retreating bystander. Arrogance, intimidation.

    Your experience reads like Rodney King and Ian Tomlinson (G20/London) writ small, but it's the thin end of the same very troubling wedge.

    Nice one, MPD. I take it the Department has given zero consideration to alienating the population that employs them and is willing to put public goodwill at risk. I'm sure glad I wasted 20 minutes of my life so they could pull over a lifted monster truck or two.

    Video taping of police in the normal conduct of their business (including arrests) in a public place is completely covered under the 1st amendment. A quick internet search will yield many instances when police have over-stepped and the arrests have been thrown out of court. Principled police welcome video taping, it serves as witness to the good work that they do.

    Pardon the intrusion here but Russo has a history of provoking adverse reactions from law enforcement. He obviously gets off on it. Anyone else with a video camera would have not have had a problem. Russo just has a way of bringing out the worst in every situation.

    After watching the video on the news. I must say the cops gave him a lot of warnings. All he had to do was listen and move. If ur dumb enough not to listen to the cops telling u to do something in a calm way, u deserve to get arrested. People always complain about cops doin nothing but when there are complaints about things and they do something about it, stupid people only cry about it. Suck it up and mind your own business. And I'm pretty sure Russo could have just listed and waited till the cops finished the stop then he would have gotten a good explanation from the police about the traffic

    Finally SOMEbody has the nerve to stand up to the Maui police. I've lived on Maui for almost 30 years and have had multiple interactions with the Maui Police Department where they have acted to irresponsibly, I am now more afraid to dial 911 than face the consequences of an intruder.

    I have half a dozen letters written on my computer that I decided NOT to send, because it is SUCH a small island. Fear of backlash and harassment has kept me quietly afraid of them. Thank you. THANK YOU Tommy for making this TRULY a day of Thanks for people like you on Thanksgiving day.

    OKAY FIRST OF ALL NOT ONCE DID OFFICER LAWSON TELL HIM TO TURN STOP FILMING. RUSSO WAS FREE TO VIDEO TAPE AS LONG AS HE WAS BEHIND THE POLICE CARS BECAUSE OF SAFETY REASONS. IF ALL OF YOU IGNORANT PEOPLE WHO ARE OVEREXAGGERATING THIS WHOLE SITUATION JUST LIKE RUSSO AND SAYING IT IS BECAUSE RUSSO WAS FILMING POLICE IN ACT YOU ARE ALL WRONG. WATCH THE VIDEO. DONT ADD SHIT YOU DONT HEAR OR SEE.

    ALL YOU PEOPLE OUT THERE BASHING ON POLICE OFFICERS NEED TO STOP. OFFICER LAWSON DID NOTHING WRONG. RUSSO WAS TOLD MANY OF TIMES TO MOVE BEHIND THE COP CARS AND TO STAY BACK AND STILL INSISTED TO ACT DUMB.
