As most of the state now knows, the travel website TripAdvisor.com has named Kapalua Bay Beach as the third best place in the U.S. to propose marriage (beaten by Central Park and the Grand Canyon, of all places). Anyway, what most of the state may not know is that this is wonderful news for Maui Land & Pine. See, the company owns the name "Kapalua." Now back in November 2005, the company Golf Getaways challenged ML&P's alleged ownership of "Kapalua" in U.S. District Court, arguing that the word was a non-trademarkable Hawaiian place name. But according to Teri Gorman, Maui Land & Pineapple Company Vice President for corporate communications, that case ended in ML&P's favor. "ML&P and Golf Getaways have settled this case with both parties agreeing to keep all terms and conditions of the settlement confidential," Gorman emailed me on Jan. 11. "Golf Getaways has acknowledged that 'Kapalua' and the butterfly logo are the registered trademarks of Kapalua Land Company Ltd., a subsidiary of Maui Land & Pineapple Company, Inc."

If it could, HTwould drop three more notches this week after Pacific Business News reported that CEO Michael Ruley has been fired, and that his "turnaround artist" replacement, Stephen Cooper, made his name by taking over Enron in 2002 after that company "imploded." MTW
