Nishiki discloses Dowling loan


Former opponent Couch calls revelation "unconscionable"

Recently elected County Councilmember and longtime politician Wayne Nishiki ran as the candidate who didn't take developer money and had no binding ties to the island's big business interests. So it came as a surprise to learn that Nishiki owes $100,000 to Dowling Co., the outfit behind such controversial projects as the Makena expansion that Nishiki and his fellow councilmembers will have to rule on in the coming term.

The loan, which Nishiki says he took while out of office to help keep his business afloat, was disclosed in a County Board of Ethics form filed October 16.

Couch and Nishiki ran a hard-fought campaign and frequently traded barbs; many of Nishiki's harshest criticisms against his opponent centered on the fact that Couch accepted campaign contributions from developers. Nishiki, meanwhile, painted himself as an independent voice. "No developer is going to come into my office," he told us in an interview shortly before the election. "I'm sorry, that's not how I operate."

In light of the loan, Couch called Nishiki's attacks against him "unconscionable." And, he pointed out, Nishiki will have to recuse himself from any vote involving Dowling Co. as long as he owes the money. "What good is a councilman who can't vote?" Couch asked.

Couch also pointed out that Nishiki filed the ethics form late. "It was due at the end of July," said Couch. "That in itself isn't a huge deal, just a slap on the wrist." But, he added, it's what's in the form that matters.

Nishiki said he will do "everything in his power" to secure another loan to pay off Dowling Co. before he takes office. He said that was his plan all along if he won the election; he didn't do it before because if he lost it would have been unnecessary, he said. "I believe I was transparent," he said, "I filed the form."

Nishiki did acknowledge that the loan is a "negative cloud that I want to clear." Asked if he should have revealed the existence of the loan to voters in addition to filing the report, Nishiki said that "might have been a good idea." But, he maintained, he was never dishonest. Furthermore, he drew a distinction between a business loan—which is paid back with interest and is given separate from a campaign—and campaign contributions.

Ultimately, Nishiki said, "the proof is in the pudding."

That may be true. If Nishiki pays the loan back before he takes office—eliminating the ethical conflict—and votes in the same anti-big development fashion he has in the past, that proof may be satisfactory to his supporters.

Yet the question remains: what if Nishiki had done more than the bare minimum and openly disclosed the loan to voters at the outset of the campaign? That would have been more in line with his message of total transparency, and might have gone a long way toward neutralizing any appearance of impropriety.

Or, Couch argues, it might have changed the outcome of the election. MTW

    Wow! Can you believe that mister "I don't take money from developers" has a $100,000 personal loan from one of Maui's largest developers??? And then hiding this fact in the months leading up to the election. This guy must have no ethics at all.

    Two drunk driving arrests, shrugging off his court ordered community service, Wayne has always shown a tendency to be unstable but this really takes the cake.

    I see from tax records that he bought a $400,000 condo last year for $125,000. I wonder what the circumstances of that deal were??? Who does he owe for that sweetheart of a deal?

    Don Don Don, do you really think that Nishiki will support and vote to support Makena development regardless of how much money he owes to the Green Goblin? Or are you saying that the Councilmembers should vote positively for people who give them money?

    Don, you are on record of saying you would have approved of Wailea 670, that one reason why you lost.

    Get over it and help Alan get elected again and aim your sights at the worst Mayor we've had in a long time.

    Wayne Nishiki made this deal with Everett Dowling - the so called BIG BAD DEVELOPER??? What does this say about his decision making, ethics, integrity,...? Wayne will never be able to vote on any Makena issue concerning Dowling and Co. again.

    It seems the holier than though attitude has some holes in it. How can someone who reported an income of $18000 be able to pay a mortgage and a loan of $100,000? Is this really a loan? If so how long has it been in place and how many payments have been made? Never has the old saying, the finger that points has three that point back, been more true. Personally I would rather have an honest political leader that I do not agree with than a dishonest political leader that tell me what I want to hear but acts in his own self interest not caring about the constituents left behind.

Add that to the fact that he's been arrested twice, balked at his community service and basically contributed nothing to society....and all this was known prior to the election.     This Magazine ultimately endorsed Wayne Nishiki because they were concerned about a $2,000 contribution to Don Couch's campaign from a developer. Now they write this article, without a retraction or even a mention of their ultimate support for Wayne. This is a sad day, because whether or not I agreed with their political stance, I have always trusted this publication's journalistic integrity. Despite its small staff and limited resources, they sought out and reported controversial issues for the public good. Yet this article, with its apparent attempt to be non-biased, instead makes me doubt Jacob's journalistic gravitis. Aren't you even a little bit concerned about Wayne's character when he blatantly lied to you? How is it acceptable to call the Liquor Commission out for their questionable integrity, whom you don't idealogically agree with, but when someone with a shared political stance was so obviously deceitful you give them a pass? Shame on you. Live your standards or lose this reader.

    Nishiki's violation of the disclosure requirements deprived Maui's voters of the opportunity to make an informed choice in this election, and it is an impeachable offense under the County Charter. The Charter permits the County Board of Ethics or 5% of the registered voters in the County (less than 5000 people)to petition the Second Circuit Court for impeachment. Who's up for Impeaching Nishiki?

    Wayne was not in office and didn't expect to run again. He disclosed this loan before the election. Nobody eer said he was perfect, but Nishiki's record of challenging rampant development, mansions for millionaires and overuse and abuse of our resources is unmatched. Imua Wayne!

    Firstly, Wayne did file the form in October, however, it did not become public knowledge until recently. All of the other candidates had their form filed by the due date for the public to know about. The voters should have had this information before they went to the polls so that they wouldn't have been fooled by his anti-development propaganda.

    Secondly, there was no question that he was going to vote no against Makena, however that is not the issue. The issue is that Dowling's Makena development will come before the upcoming council, a development that will have a huge effect on the South Maui community. And now because of Nishiki's conflict, he as South Maui's "representative", will not be able to speak out against it. One less no vote for Dowling to deal with.

    How you can continue to sing his praises is beyond me. What good is a councilmember that can't vote on an issue?

    Finally, now everyone can see what was so aparant all along - Wayne Nishiki is an extremely dysfunctional alcoholic, with very impaired judgment. He originally filled out the financial disclosure form on July 15th and then didn't turn it in until October 16th, making up excuses all along. He knew that the Ethics Committee didn't meet until November 12th, until after the election - so he waited until after the October meeting and then submitted it. This is all very calculated - but still not very smart. We the public now know. That he thinks he's going to get away with it is a testimony to his impaired judgment and to his experience with Maui voters of "getting away with murder." Let's not continue to be chumps.
    Impeach him now!!!

    I have voted for Nishiki in the past, But I want to say, I am very dissapointed, In what I have been hearing and reading about his past escapades. So again I say, if we are going to be Law Biding Citizens, and do the right thing, it is our duty to impeach him immediatly. If this is not done , then I am thinking there is some thing wrong in Denmark, and all of his cohorts should go down with him.

    All you people should get a life and mind your own business. This forum is filled with ignorant people who don't understand County politics. Wayne will be able to participate in full discussion of all business. If he recuses himself for a vote on a Dowling project it is counted as a "NO" vote! A recused vote is a "NO" vote! So all you so called concerned Kihei people-if you really want him to vote no on a Dowling project that is what you get, undoubtedly that is not your concern or you would stop your whining. You can also count on the usual five votes for all developments so what do you have to complain about? Wayne, Sol, and Joanne are a minority vote on council and therefore you have nothing to complain about. Tell me one thing he won't be able to do that you want done concerning "representing South Maui," that's right you got nothing! We all know it is just a bunch of poor loser haoles who don't know how to mind their business and move on. Go back to Floriduh and rest in peace in your Disney development!

You get what you deserve Maui locals....local politicians who are either in the pocket of the plantation owners and their developers, or are openly corrupted by them. They are wined and dined and paid off with jobs when they leave "politics" and Maui picked to the bone by the boys with the big bucks. Maui is a joke where you can have your name on the ballot without filing your forms...if your name happens to be Nishiki (not a haole name).

Why do you think the fat-ass chamber of commerce spokeswoman came to his ethics board? Because she's afraid he's "bad for business," which translates to bad for big business and plantation owners. Why do you think the turtle-man Dave Deleon was there? Because he represents the big developers -and they are scared to death of Nishiki.
    Why don't you go after the five that ARE in the pockets of big business and development. Pontanilla, Victorino, Molina, Medeiros and Baisa? WHY? Because you don't really care, you think it's all about you and your dumb idea of what politics are here. Go away Mark, you twit.
