MauiTime Publisher Tommy Russo Assaulted By MPD

On the evening of April 12, I was assaulted by a member of reality star Duane "Dog the Bounty Hunter" Chapman's security team. Soon after, I was assaulted again, and had my First Amendment rights violated, by a member of the Maui Police Department.


It began around 9pm, when I exited my Wailuku office. As I was crossing the parking lot, I noticed a number of large SUVs directly adjacent to my vehicle, and heard a woman asking for an autograph. Naturally curious, I pulled out my camera and started shooting video. Immediately, Chapman's security guards began pushing me away. I informed them I was a member of the press and I had the right to film on public property.

This did nothing to dissuade them, and after a security guard who I later identified as Sonny Westbrook shoved me particularly hard I announced I was calling 911. The security guard then snatched my phone out of my hands and jabbed me in the mouth with his open palm, making direct contact with my upper front teeth and knocking my head back. At this point I began yelling for help.

After repeated demands, the security guard finally threw my phone down on the hood of a car; I grabbed it and called 911. While I was making the call, another member of Dog's entourage who I recognized as his wife, Beth Chapman, began yelling at me, making it difficult for the operator to hear me. While I was still on the phone with 911, MPD officers arrived at the scene.

I explained what had happened, and while one of the officers took my statement I continued recording with my phone. The Dog crew moved behind a van and I shifted slightly to get a better vantage point. It was then that Officer Nelson Johnson of MPD told me I was "antagonizing" Dog's gang. I panned the camera over to Officer Johnson and he charged me and hit me in the face opened-handed as he violently yanked the phone from me. I demanded he return it and he did, at which point I began filming again.

He then charged me a second time, and as I turned away from him and shoved my phone in my pants he grabbed me and twisted my left arm behind my back, wrenching it painfully. I pleaded with him to stop, telling him he was hurting me. That only made him wrench harder.

This went on for at least three minutes. I was screaming for help. The more I screamed in pain, the more Officer Johnson wrenched my arm. The video clearly shows I remained calm; I was doing nothing more than filming the incident, and for that I was assaulted by a public servant on public property. I repeatedly explained to him that I was a member of the press and cited my First Amendment right. Officer Johnson erroneously claimed my press rights didn't include filming him against his wishes.

After the assault, Johnson fabricated a story that I charged him with the camera, but the video evidence (which can be viewed on our news blog, mauifeed.com) clearly refutes that.

Soon a higher-ranking officer arrived on scene. As I was explaining the incident to him, I watched in the background as Officer Johnson got his chance to go meet the TV star Chapman, and they shook hands and laughed together.

I challenge Dog and his crew to release their video footage of the events.

Bottom line: because I attempted the completely legal act of recording on public property I was shoved, hit, had my property taken and was prevented from accessing emergency services. Once "help" arrived, I was further assaulted and had my Constitutional rights violated.

This type of injustice cannot, and should not, stand. The police are supposed to serve and protect. When they fail in that duty, they must be held accountable.

    Kudos to Maui Time and Tommy for sharing this video and story. There is a reason the Maui News WILL NOT run negative stories about the police. This video is a prime example of why we need independent journalists on these islands. The Maui News / Chamber of Commerce / MPD can squash this story all they want in their quarters. I'm sure they'll gang up on Maui Time to discredit this paper instead of addressing the issue.

    This MPD Johnson guy got red-handed and it needs to be addressed by his superiors. Many people have lost confidence in the MPD to not be bullies and corrupt. This video proof of what they are talking about.

    Granted a majority of the MPD are upstanding citizens and servants and I applaud them. How about the Police Chief getting on his high-horse and rid the MPD of these types of officers? LOL I know, his hands are tied by the police union to do anything about it. Wonderful...and what a great excuse. Now we know why there are so many unsolved crimes and drug dealers roaming the streets without fear of prosecution. The smallest towns can be the most corrupt sometimes, It's your job Police Chief to address this.

    Tommy- I'm saddened but not too shocked. I really really hope that they messed w/ the wrong guy on this one. I can't remember the last time I heard apositive story regarding a MPD encounter. Its like they can't be bothered are on a rampage or will assualt someone and usually take most anything of value from that person instead of arresting them for whatever bs they dreamnt up.

    Viva la revalution !! Its gotta stop and the LC are next !!

    This "Officer" obviously thinks he's above the law. I hope Tommy charges him with assault. What a disgrace to the force.
    And what about Dog the mullet wearer and his crew? Aren't they constantly running around filming? Yet they think they have the right to keep others from doing so. Also, isn't there a law against iterefearing with a 911 call? Of course we already knew they were no mental giants. I wonder what they would've done if it was their camera that was taken.
    Sorry Tommy. It just goes to show: You don't have to take too many steps out the door before you run into a Buffoon Convention!

    Seems they can't find Laura Vogel or Yesua Boerstler's killer or how many other crimes that need attention and solving but they find the time to jerk off with the DOG and then slap and bully citizens and then lie about it when it clearly shows MPD Johnson move aggressively toward the guy.     Sorry that you had to experience such violations! And by the hand of one who is supposed to "protect and serve"...yeah, right. The police here take this so lightly. I am so glad you put this story out into the public. Our community needs to know to be aware of this. I have heard one too many horrific stories about the corruption and abuse they have inflicted. Talk about going BEYOND the call of duty...in such a BAD way. According to Dateline NBC, in 2008, MPD was rated the most corrupt department in the U.S. Can you imagine what its like now?

I was born here, my family dates back to arriving on Maui in 1895, I've heard epole say that they can't trust our MPD and I've stood up for them as I have a few friends that are ranking and retired officers of MPD, however this incident totally destroys my defenses for them. In regards to Dog, I read a bumper sticker recently which said, "Thank you for visiting, now go home" this applies more to Dog and his group then any tourist I met. WE DON't NEED YOU. That whole incident was totally "NO SHAME BULLSHIT". sad, very sad and diappointing.

    Officer Johnson... as I once knew him as "Coach" from high school, sad to see a person I once looked up to for guidance and "help" is now someone I would fear. (SIGH)

    All I ask of Tommy Russo is that you put in the heading of the vulgar language to let people know that there is swearing as soon as you click play. Not cool when there are children near the computer and the first thing they hear is !@#$%^.

    Sorry for what happened to you brah, I think that was lame of the dogs crew and his wife Beth for acting in such an unprofessional manner they make our Hawai'i look bad, as well as officer Johnson whom is a top faggit of an officer for doing such a thing like that all I gotta say is they jus better keep on there toes because they get families and when they stop doing things like this which is not PONO then imagine when they mess with the wrong person...!

    Notice how there is nothing recently posted about the killers? About the girl who was being raped that Yesh tried to save? Because one of the MURDERS was related to the Police Chief at the time (Clifford Pacheco) not a hanai family, it was HIS SON. The rape of Astara (girl that Yesh was protecting) went no further in investigations. It took months and months for anyone to convict the killers and they barley served anytime in jail. Its a bunch of BS. MPD CAN SUCK A D**K! I believe that Tommy Russo was assaulted because the cop is too ignorant to do his job correctly. Just like the officers and detectives assigned to Yesh's case. You have better luck getting help from the junkies in Lahaina then officers of MPD who actually obtain MORALS and have an understanding of what it mean to PROTECT people of the aina. No one should have to go through what you went through Tommy but until someone helps you make a stand, nothing will change. I believe the fuc**rs who killed Yesh deserve to be dead at the bottom of the Ocean along with all the untrustworthy officers in Maui. I am not saying all the officers are like this but there is a surprising amount. THIS SHIT NEEDS TO STOP! IT NEEDS TO STOP BEFORE MORE CHILDREN, TEENS, AND ADULTS ARE HURT BECAUSE OF IT. Google MPD and you wont find nice things. This incident is just another screwed up thing that Maui police have done.     OK what most of you are saying is true but do you have all sides to the story? Have u ever been a police officer before? What is funny is even though people like the press and the media say what about catching the bad guys, they often help the bad Guy or murder get away. The more you inform the world the more you inform the bad guys on what is Going on. This is what I don't understand instead of video taping the good guys go to a drug dealers house and video tape them. Over and over u see videos on police, CBP, and TSA all over you tube yet you don't see to many of the people filming drug houses or stopping a killer or a terrorist and sticking a video camera in there face. Yes there are laws and yes there are right but those laws and rights don't help u when some one pulls out a gun and shoots u while ur on The job. So to you, you know you are harmless but did he know that? Put yourself into someone else's job before you post things. These rules and rights are here to protect us and there are many other approaches both people could have took, but these rule and rights also are what brought down our twin towers our symbol of America. You could have just walked away from the begainings and respected what they were asking of you and they could have been a little more professional about it but then again they have been through situation you Mr media Guy have no idea about.

    Officers of the law are employed to protect the freedoms granted us as citizens under the Constitution, whether they agree with that or not, that is their sworn duty. Whether Tommy was acting as a journalist, a concerned citizen, or yes, even a paparazzi, his rights are the same in this case as he was on public property. Anyone acting in the public domain inherently takes the risk of being seen by others, that includes having pictures taken or video recorded of them. Tommy's 1st Amendment freedoms appear to have been clearly violated in this case and it also appears that he was assaulted by an officer of the law, which does not deem well for the officer or the Maui Police Department. It is unfortunate that these events took place, I hope Tommy takes further action in this matter to help protect those who might find themselves in a similar situation in the future.

    Several times I have called on MPD for help and all I can say is that they are no help at all! Most of the officers have no brains and big egos. They are lazy and cannot add 1+1. I have lost all respect for MPD. They need a new chief of police who has the courage and smarts that can do a through house cleaning and get rid of the thugs that hide behind their police badges, and get some real police officers who are respectable, honest, caring, and who are not lazy to do their job right.

    I hope that by the horrible encounter Tommy had with MPD that it will help to clean out all the losers in MPD and we'll be able to get a whole new MPD whose sole purpose is to "Protect and serve the citizens of Maui".

    All personal opinions aside, the police have a duty to uphold the laws and rights of us, the citizens. They are no better than we are, nor are they above the law. This officer had no right or justification in doing what he did other than plain old intimidation, a tactic that MPD obviously utilizes regularly. If we did this we would have been charged. MPD should do what is right and reprimand this officer for his offenses, if not let him go completely. I understand he is a veteran of many years, so what. That is STILL no justification. Do what is right. Get rid of these bad apples and redeem the name and re-earn the respect that should be deserved of MPD.

    2. Johnson: A cop from Makawao who shot an unarmed woman Jan 24, 2004 2 weeks after Astara Evenstar was murdered. He was given 3 months paid vacation following this incident. I heard that that the woman he murdered was pregnant by him, and he is a married man.

    Bounty hunters are on the edge of death daily with their work, along with the MPD..it's always advisable to be courteous about footage of people and events, in this day with blogging, youtubes and other media material. It's obvious that a provocation occured and got out of hand a bit. Just like with the paparrazi....most celebrities hate footage that is not consented for by thier own rights...no matter what..constitutional rights run on both sides of this issue...however, one warning should have been enough...try not to play victim, it appears whimpy....public servants have rights too....try to treat others as you would wish to be treated...including with a camera, and the power of the pen...save us all the negative press... of people who are really trying to get some peace in order to face the drama again, God knows it must hurt on both sides...try not to target the MPD...who are already compromised by budget cuts in this county...we need to support our law enforcement...we depend on them to keep the peace & safety of our community. Thank you for forgiving those who know not what they do.

    Drama is what sells. I've watched them once or twice but it was a joke and more a commedy than a good show.
    The man is a covict, druggie, and looser that turned his life into a show that hurts people that are down and demeans them on tv and even makes him look like he cares. Innocent until proven guilty, but hancuffed,houses charged, people pushed, hit, and abused so he can get his limelight.

    Now I don't care for officers, lawyers, or reporters either, but when dealing with cops, famous actors, and a chance to get on tv, you are not going to win. Hopefully you go to court and see if they can take care of the mess.

    Wow finally someone catches the corrupt Maui police who think they are above the law NOT doing their job as usual. Do and his crew are NOT police they think they are and need to be put in their place. Please Tommy file a lawsuit against the Maui Police, Dog and his crew, you will have so much support from the people of Maui and the rest of the world. We lived in Maui for six years and left the island in disgust as nothing is ever done to stop the drugs, and corruption is unbelievable. I live in Canada now and I saw this so people out there are watching. I will help spread the word brother

    just because you were inside your legal rights doesn't mean you weren't acting like a jerk and pissing them off by filming when you knew it was agitating everyone involved.

    Officer douche bag is my neighbor and very unfriendly from the day he moved in. I've seen him do some terrible things. Let's just say, I don't have one nice word to say about him. Neither do my other neighbors. He's definitely out of control and in need of some professional help.

    If the Chief of Police doesn't do something about this "cop" then the citizens should do this: Complain to the city administration office at city admin meetings and demand that the Chief is fired. If the city manager (who often does the Chief hiring) doesn't do what is demanded then the citizens must promise to recall or vote out the city manager and if necessary every single person on the city council. That will get their atention. Start going to the city meetings and make some noise.
